1. Agreement
These Terms of Use (the “Terms”) are an agreement between you and Braza IO Capital Holding (“Braza IO”, “we”, “us”), a company established in Brazil that develops EmuHall. They apply to the EmuHall application, its installer and portable versions, getemuhall.com, and the online services EmuHall uses on your behalf (together, “EmuHall”).
By downloading, installing or using EmuHall you accept these Terms. If you do not accept them, do not use EmuHall. If you use EmuHall for someone else, such as a child in your care, you accept these Terms for them and are responsible for their use.
2. What EmuHall is
EmuHall is free software that organizes game files you already have and plays them with emulator engines. It does not sell, include, download or link to games, BIOS files, firmware or console keys, and it does not decrypt or remove copy protection from games.
EmuHall is made of three parts with different licences. The EmuHall launcher (the application, its interface and the EmuHall name, logo and artwork) is proprietary freeware owned by Braza IO and licensed to you under these Terms. The EmuHall player is open source under the MIT licence. The emulator engines are independent open-source projects, each under its own licence (for example the GNU GPL), listed with their source on the Credits page.
Nothing in these Terms limits the rights an open-source licence gives you over the player, the engines or any other open-source component. Where these Terms and such a licence conflict for that component, the open-source licence prevails.
3. Your licence to use the launcher
Braza IO grants you a personal, worldwide, non-exclusive, non-transferable, revocable and free licence to install and use the EmuHall launcher on devices you own or control, for your personal use, in line with these Terms.
You may not, except where a law that cannot be waived allows it: sell, rent or charge for EmuHall or access to it; distribute EmuHall bundled with games, BIOS files, firmware, keys or other content you are not entitled to distribute; distribute modified copies of the launcher or present them as EmuHall; remove or alter copyright, licence or trademark notices; or use the launcher’s code, design or artwork to build a competing product.
You may share links to getemuhall.com and the official GitHub releases. Official downloads come only from those two places; we are not responsible for copies obtained elsewhere, which may be altered or harmful.
4. Your games and system files
You are solely responsible for the games, BIOS files, firmware, keys and other content you use with EmuHall. Use only content you have the legal right to use, such as copies you made yourself from games and hardware you own, where the law where you live allows it. Laws on backups and emulation differ between countries; it is your responsibility to know and follow the ones that apply to you.
Braza IO does not endorse or support piracy or the circumvention of technical protection measures. We do not provide, request or knowingly accept unlawful content, and we will not help anyone obtain it. Requests for games, BIOS files or keys sent to us will go unanswered.
5. Acceptable use
- Do not use EmuHall to infringe copyrights, trademarks or other rights, or to distribute content you are not entitled to share.
- Do not use EmuHall to circumvent copy protection or other technical protection measures where the law forbids it.
- Do not misuse EmuHall’s online services: no automated or excessive requests, scraping, attempts to bypass rate limits or security, or interference with other people’s use.
- Follow the rules of services you connect through EmuHall, such as RetroAchievements’ rules on cheating and hardcore mode, and PlayerHall’s terms.
- Do not use netplay or any other feature to harass, defraud or harm other people, or to send them unlawful content.
- Do not reverse engineer the launcher except as permitted by law or by an open-source licence for the relevant component.
6. Online features and third-party services
Some features use online services: game artwork and details come from a catalog run by Braza IO with data from RAWG and other game-data sources; achievements come from RetroAchievements; profiles come from PlayerHall; update checks use GitHub. These features are optional conveniences: EmuHall plays your games without them.
Third-party services are run by others under their own terms and privacy policies, which apply when you use them. Braza IO does not control them and is not responsible for their availability, accuracy or conduct. Game names, artwork and descriptions belong to their respective owners and are shown for identification only. We may change, limit or stop any online feature at any time.
7. Feedback
If you send feedback, bug reports or ideas, you allow Braza IO to use them freely to improve EmuHall and our other products, without payment or obligation to you. Do not include other people’s personal data, passwords or content you are not allowed to share. How we handle reports is described in the Privacy Policy.
8. Trademarks and independence
EmuHall, the EmuHall logo and icon are trademarks of Braza IO Capital Holding and are not licensed under any open-source licence. Console, game and company names belong to their owners and are used only to describe compatibility.
EmuHall is an independent project. It is not affiliated with, sponsored or endorsed by Nintendo, Sony Interactive Entertainment, Sega, Microsoft or any other console maker, game publisher, or emulator author.
9. No warranty
EmuHall is provided free of charge, “as is” and “as available”. To the fullest extent permitted by law, Braza IO disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that EmuHall will run every game, emulate it accurately, be error-free or uninterrupted, or that save data, save states or settings will never be lost or become incompatible between versions.
Keep backups of your saves and anything you care about. Emulation can fail in ways that corrupt or lose progress.
10. Limitation of liability
To the fullest extent permitted by law, Braza IO, its partners, employees and contributors will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, saves, profits, goodwill or use, arising from or related to EmuHall, even if advised of the possibility. Because EmuHall is free, our total liability for any claim related to it is limited, where the law allows, to fifty United States dollars (US$ 50) or the equivalent in your currency.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, or the rights consumers have under mandatory law, such as the Brazilian Consumer Defense Code (Código de Defesa do Consumidor) or the consumer laws of your country of residence.
11. Your responsibility to us
Where the law allows, you agree to defend and indemnify Braza IO against claims, damages and costs, including reasonable legal fees, caused by your breach of these Terms, by content you use with EmuHall without the right to do so, or by your violation of someone else’s rights.
12. Changes and ending
We may update these Terms. The current version and its date are always on this page; for a material change we will also say so in the release notes or on getemuhall.com. Continuing to use EmuHall after a change means you accept the new Terms; if you do not, stop using it.
You may stop using EmuHall at any time by uninstalling it or deleting its folder. Your licence to use the launcher ends automatically if you materially breach these Terms. Sections 4, 7, 8, 9, 10, 11 and 13 survive the end of this agreement.
13. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved by the courts of the city where Braza IO Capital Holding has its registered office, unless mandatory law gives you, as a consumer, the right to bring or defend a claim in the courts where you live, in which case that right is preserved. If any provision is found unenforceable, the rest remains in effect. These Terms are the whole agreement between you and Braza IO about EmuHall; a failure to enforce a provision is not a waiver of it.
14. Contact and legal notices
Questions, legal notices and claims that content made available through EmuHall’s services infringes your rights: contact Braza IO Capital Holding through brazaholding.com, naming EmuHall. For copyright claims, identify the work, the material you believe infringes it and where it is, your contact details, and a statement that you are the rights holder or authorized to act for them. Bug reports and ideas are best sent through the feedback page.
